Woman sues hospital for nursing error in regard to paternity

When a doctor or nurse provides one with information, New York residents generally believe them. After all, they are the ones who went to school and have received training in medical care. However, it isn't uncommon for a nursing error to occur that can result in serious harm to a patient and his or her family.

In 2011, a woman gave birth to a baby. A nurse who was on duty at the time of the birth said that blood tests showed that the woman's husband was not the father of her baby. She had apparently been artificially inseminated, so the couple thought that the fertility doctor was the person responsible.

However, in 2012, the couple filed for divorce. The divorce led to the conduction of more tests to determine the paternity. These tests showed that the woman's husband was in fact the father of her baby.

The lawsuit alleges that the woman suffered emotional distress as a result of the false information provided by the hospital nurse. Further, the woman and her husband took part in counseling to try to deal with the belief that her husband was not the father of the baby that she had given birth to. She is seeking various damages for loss of consortium and emotional distress.

New York residents who have suffered physical or emotional harm due to a nursing error would do well to remember that they have rights under New York law. There are state laws that provide an injured individual the ability to pursue legal action against a nurse or hospital institution that was guilty of negligent actions. A lawsuit can recover damages for physical and emotional harm caused by the negligence.
