Medical malpractice suit filed after boy is misdiagnosed and dies

To many in New York, doctors are considered miracle workers. Unfortunately, they make mistakes just like the rest of us. However, physicians and hospital staff are required to provide a certain standard of care when dealing with patients. When that level of care is not provided and results in the serious injury or death of another, they can be held liable for their negligence. Recently, a young boy's family filed a medical malpractice lawsuit against a doctor and the hospital where he practices for allegedly misdiagnosing their son, which ultimately resulted in his death.

Apparently, the six-year-old boy had a collision accident with a pole while playing on the school playground. The boy was in extreme pain when he arrived at the hospital. The hospital performed an X-Ray and concluded that the boy was constipated. The doctor diagnosed him with this and released him.

A few hours later, though, the boy began to lose consciousness and the family knew something was wrong. This time, they called an ambulance. Unfortunately, the boy passed away on the way to the hospital.

An autopsy was ordered, which showed that the boy's kidney was damaged. In addition, he was bleeding internally, which led to a hemorrhage. These are issues one would think would be prevalent in an X-Ray.

The family has retained counsel and filed a lawsuit. They are likely aware that a successful litigation claim will not bring their son back to them, but it may provide some sort of justice for them. Just as with similar lawsuits in New York, a successful medical malpractice claim may award monetary damages that will help the family pay for medical bills, funeral expenses and pain and suffering.
