Surgical error leads to lawsuit for wrongful pregnancy

When a couple wants to conceive a baby, finding out that they are pregnant can be a time of pure bliss. However, many couples in New York undergo certain sterilization procedures so that they cannot conceive. Unfortunately, when these procedures fail, a couple can be burdened with an unexpected pregnancy. After a surgical error, this is what happened for one woman and her family in another state.

One of the common sterilization procedures woman undergo to prevent pregnancy is a tubal ligation, which is more commonly known as having her tubes tied. This is exactly what this woman had done after she gave birth to her third child. Because of this, it was a complete and utter shock when they found out they were pregnant a few months later.

Unfortunately, it would appear that the physician tied the wrong tube, which resulted in her still being able to conceive. The woman had lost one of her ovaries when she was younger and found out that she could easily give birth to a child with a sickle cell disorder. Now, the couple is faced with extreme medical expenses because the child, who had a 25 percent chance of inheriting it, was born with sickle cell disease, which is a rare blood disorder.

Although many in New York may see becoming pregnant as a blessing, not everyone is emotionally or financially prepared for a child, which is why individuals undergo certain sterilization procedures in the first place. When a doctor performs a sterilization procedure incorrectly and this leads to a wrongful pregnancy, an individual may be left with numerous financial problems, such as loss of income and medical expenses. Luckily, there are legal options available for those in these situations, and a successfully litigated claim may be able to help one obtain financial amends for the surgical error of the physician.
