Newborn suffers permanent brain injury, family suing hospital

New York hospitals are expected to provide a certain standard of care when patients are admitted for medical treatment. Unfortunately, many hospitals are understaffed, which can lead to a wide number of issues. Right now, three families are going head-to-head with a hospital after mistakes were allegedly made in the delivery room due to apparent negligence and understaffing, with one of the cases resulting in permanent brain injury to an infant.

That particular lawsuit alleges that the hospital physicians did not recognize or respond properly to the woman's labor process. Ultimately, she needed a C-Section and the complaint maintains that doctors failed to determine this in a timely fashion. Then, once it was determined, the incision was delayed for an inappropriate amount of time for unknown reasons.

The delay reportedly resulted in the baby being born lifeless. The lawsuit also claims that physicians did not timely respond to the lifeless baby. In fact, the suit claims that infant was without oxygen for nearly 15 minutes. In addition, the family alleges that the hospital was inadequately staffed, which essentially put the woman's baby in danger due to the lack of care that was provided.

Because of various actions that were and were not taken that day, the baby has allegedly suffered a permanent brain injury, which will result in the need for lifetime care and costly medical expenses. The family is suing the hospital for roughly $40 million, and two other families who suffered similar experiences are doing so as well. Any individual in New York who has been a victim due to hospital negligence might do well to consider their legal options in order to hold the responsible parties liable for the physical, emotional and financial damage that they have caused.
