CVS sued by woman after receiving wrong dosage of prescription

Most New York residents put trust in their physicians and pharmacists that they will provide proper medical care, medications and dosages of drugs. In fact, most never give a second thought to their prescription once they receive it from their pharmacist. It is just assumed that a medical professional would provide accurate instructions and the proper dosage of medication. Unfortunately, this is not always the case and wrong dosage prescriptions can be given, which may result in serious harm.

In Jan. 2013, a woman from another state received a prescription for Lovenox after having a laparosopic gastrectomy. She was to take 0.4 mL of the drug, which she had filled at a CVS in her area. However, just over a week later, she went to the emergency room with a possible gastrointestinal bleed.

It was at this time that it was discovered she had been taking 1 mL of Lovenox, which was more than double the amount it should have been. The overdose of this medicine is allegedly what led to the injury and need for further medical attention and care. She is seeking over $50,000 in damages related to the alleged medical negligence.

New York residents may be able to seek compensation in a civil court of law for the negligence of pharmacists, physicians and other healthcare professionals when it results in injury or death. A monetary award from such a case may assist in medical expenses, funeral costs, loss of companionship, emotional anguish and other related damages. Although medication errors, such as the wrong dosage given, should not occur, they do more often than some people think and medical professionals should be held accountable for any improper actions.
