Mother sues physician and hospital for birth injury of son

During what should be the most joyous time of a parent's life, many New York mothers experience complications during delivery, which can lead to short- and long-term health concerns for both mother and baby. In many cases, when a birth injury occurs, irreparable damage is caused that cannot ever be repaired, leading to long-term medical care necessary. A mother from another state has filed a medical malpractice claim against doctors and a hospital after they allegedly caused irrevocable harm to her baby at birth.

The woman was admitted into the hospital in Aug. 2011 to give birth to her son. Unfortunately, the delivery wasn't as smooth as most women hope. Although she was able to deliver the head with no problem, she had difficulty with the baby's shoulder. The problem was allegedly due to the boy's weight, which may have been prevented had the physician estimated the baby's weight prior to the delivery.

The physician that was performing the delivery reportedly used excessive pressure to deliver the baby's shoulder. This then led to irreparable nerve injury, limited use and movement of his shoulder, hand and arm and extreme pain. If the physician had opted for an emergency C-section instead, the lawsuit claims that irrevocable damage may have been avoided.

Now, the mother, on behalf of her young son, has filed a medical malpractice claim in hopes of recovering monetary damages that she believes her son deserves due to this birth injury. Many victims of medical negligence that has caused a birth injury or other harm have the right to hold the physician and the hospital responsible for their negligence in the labor and delivery process. Financial compensation may assist with past, current and future medical costs, emotional anguish and other related damages for New York victims of medical negligence.
