Surgeon accused of surgical mistake during routine hysterectomy

It is a well-known fact here in New York that surgical procedures carry a number of health concerns and the risks of complications during and after surgery. It is simply part of the medical process. However, in some cases, complications can arise due to a surgical mistake by the surgeon. A patient from another state has filed a medical malpractice lawsuit after a mistake made by her surgeon in the operating room.

A woman underwent a hysterectomy at the end of March in 2012. After the surgery, she complained of bleeding. However, the physician said that her bleeding was expected and normal.

A little over a year later, the woman visited the emergency room. She was still having problems with bleeding. Roughly one month after the ER visit, it was found that her uterus had not been completely removed during the hysterectomy.

Apparently, the physician had left cervical and uterine tissue in place. This required her to undergo necessary medical treatment. The patient is accusing her physician of failing to respond to her post-surgery symptoms and failing to exercise reasonable care, among other allegations.

This particular case may have happened in a different state, but residents of New York can likely imagine the suffering that this woman has gone through. When a surgeon or other medical professional fails to provide the appropriate standard of care, which then leads to the death or serious injury of a patient, one may have the right to file a medical malpractice claim against the negligent party. Whether a medical device had been left behind after a surgery or an organ was not fully removed during surgery and led to problems afterward, it may be possible to recover monetary damages for medical expenses and pain and suffering due to that surgical mistake.
