Medical malpractice suit filed after alleged cancer misdiagnosis

Physicians spend years in school and residency before they are allowed to treat patients on their own. They are then presented with almost every type of case that they could possibly see in the future. Although they have the medical knowledge to diagnose and treat most conditions, they may sometimes make mistakes that result in medical malpractice claims.

A couple outside of New York took their son to a doctor more than a dozen times because of the boy's sickness. The physician continued to assert that it was just a very persistent fever. The parents requested that the physician look at swelling on the boy's bottom, but no additional diagnosis was ever made.

In August 2012, the parents took the boy to a children's hospital in their home state. It was at this time that the boy was diagnosed with cancer. The type of cancer that the boy had did not grow at a fast pace.

Because the diagnosis was allegedly not made early on and treatment was not provided, the boy had to take part in aggressive chemotherapy. Unfortunately, surgery was not an option for the boy. This was due to the germ cell tumor being so large in size that it had begun to intertwine with the boy's nerves and arteries.

Due to the aggressive nature of the chemotherapy that the boy had to undergo, he suffered loss of hearing and significant pain and suffering. In addition, he is now at risk for medical complications in the future. The family is seeking monetary damages in excess of $100,000 for pain and suffering and other related damages that were allegedly caused by the physician's medical negligence and failure to diagnose the boy's cancer. Individuals in New York who find themselves in a potential medical malpractice situation may have the right to pursue financial compensation as this family did.
