Alleged surgical mistake results in a man's permanent injury

When a person schedules a surgery in New York, there is an expectation that it will be performed accurately. After all, they are likely paying a substantial fee for quality service. Unfortunately, a surgical mistake may occur, which can sometimes leave a patient with a permanent and irreparable injury.

A man from another state underwent a kidney operation in Dec. 2012. He had previously been diagnosed with cancer in his left kidney. He was to have the artery to his cancerous kidney cut and tied.

While an artery was cut and tied, it was the wrong one. Instead of having the surgery performed on the cancerous left kidney, it is claimed that the surgeon negligently operated on the right kidney, which was not cancerous. Although the proper procedure was performed later, the right kidney could not be repaired. Because of this, the patient had to undergo dialysis treatments.

The physician who performed the surgery is now being sued for his alleged reckless actions in the operating room. The lawsuit states that the surgical error resulted in the man suffering a debilitating and irreparable injury. For that reason, he is seeking an unspecified amount of compensatory and punitive damages, along with legal fees.

In a surgery, there is simply no room for error, and victims of medical negligence have legal rights. If surgical mistake claims can be supported by adequate evidence in a civil court in New York, the victim, and sometimes the victim’s family, may be awarded financial restitution for the harm that has been caused. This may result in compensation for lost wages, lost quality of life, medical expenses, pain and suffering and other related damages.
