Did a surgical error lead to a man's amputated penis?

Surgical errors occur more often than anyone would like. In some cases, a New York resident may go into the operating room for one procedure, yet have a completely different surgery performed. When this happens and an unnecessary procedure is performed, a patient likely has grounds to file a medical malpractice suit against the individuals responsible for the surgical error.

A man from another state recently underwent a routine surgery. He was to have a circumcision. Unfortunately, when he came out of the operating room, his penis had been amputated.

The man alleges that when he was informed of the risks associated with the circumcision procedure that possible amputation was never mentioned. He further asserts that no one ever explained to him after the surgery why his penis had to be amputated. He has no idea how or why it happened.

He and his wife are suing the doctors who performed the surgery for medical negligence, medical malpractice and other forms of wrongdoing. They are seeking an unspecified amount in monetary damages. The medical institutions involved have also been sued.

Unless consent is provided ahead of time, physicians do not have the right to perform any type of procedure other than what is scheduled. There are circumstances where an emergency life-saving procedure can be performed. However, the defendants' attorneys will be required to prove that this is what occurred. Anyone in New York who feels that they are the victim of medical negligence or a surgical error may benefit from learning about their legal options so that the responsible parties can be held liable for their mistakes.
